The Planning and
Land Development Regulation Commission (PLDRC) consists of seven members appointed by the
Volusia County Council. The commission's regularly scheduled meeting is held the second
Tuesday of every month, at 9 a.m. in the County Council chambers of the Thomas C. Kelly
Administration Center, 123 West Indiana Avenue, DeLand.
Decisions of the PLDRC on rezoning and special
exception cases are recommendations to the County Council and do not constitute a final
hearing. New evidence may be introduced at the County Council public hearing on the
rezoning request. Decisions on special exceptions and variances made by the PLDRC
constitute final action, subject to an appeal to the County Council. An appeal must be
filed within ten working days of the date of the rendition letter. No new evidence can be
presented at the County Council appeal hearing. An aggrieved party that appeals such a
decision is confined to the record made before the PLDRC.
Hearings by the PLDRC on variances are
quasi-judicial in nature, meaning the PLDRC is charged with making decisions in a general
manner of courts, and must take into account all oral, written and demonstrative evidence
presented. The Commission's decisions on these cases must be based on competent,
substantial evidence in the record. Competent, substantial evidence has been defined as
that evidence a reasonable mind would accept to support a conclusion.
