In June 2022, Belvedere Terminals initiated a pre-application meeting with Volusia County Planning and Development Services to discuss the conceptual framework for a prospective fuel terminal at 874 Hull Road, Ormond Beach, Florida 32174. Representatives from Ormond Beach were not present at the meeting and did not possess any documentation related to the pre-application discussion at the time of the meeting. During the meeting, it was confirmed that the property under consideration has held a future land use designation of Urban Light Industrial and a zoning designation of Heavy Industrial (I-2) since 2006. The proposed fuel terminal project is a permitted use within the current Future Land Use and Zoning designations.

A development application was not filed for the proposed project, no further communication occurred, and Volusia County has not initiated a development review process for the property. In August 2023, the Volusia County Council and Administration became aware of the proposed project and public opposition related its development. To address the emerging concerns, the County Council unanimously directed staff to:

  1. Meet with state and federal agencies and the property owners to discuss the project
  2. Review public notice issues associated with the Florida Department of Environmental Protection permit
  3. Research case law on similar issues on how they have been dealt with and the outcomes
  4. Research availability of alternative lands

Volusia County’s Administration and Office of the County Attorney remain in regular contact with Ormond Beach’s City Attorney staff and have communicated with the Florida Department of Environmental Protection’s general counsel. In addition, Volusia County has retained an expert to review the minor air construction permit to determine if it procedurally and technically adhered to state law. Outreach to numerous state and federal level elected officials to convey public concern regarding the proposed fuel terminal remains ongoing, and Volusia County is actively seeking alternative locations that may serve the site requirements for consideration by Belvedere Terminals.
